Terms & Conditions

1.The Nanny Club acts in the capacity of a recruitment agency, which means that we introduce our candidates to clients, according to the specification stipulated by the client. The Nanny Club also acts as a recruitment business and will employ candidates for temporary and permanent roles, and charge administration fees for this service, upon client request.

2.Should the client choose to manage the employment of their selected nanny, the client warrants that they will employ successful candidates lawfully and The Nanny Club is not responsible for the client’s decisions or actions in selecting and employing candidates.

3.Should The Nanny Club manage the employment of a client’s selected nanny, we warrant that we will employ chosen candidates lawfully and will respond to client’s direction regarding the selection and employment of the nanny.

4.A client interviewing and/or employing a candidate introduced by The Nanny Club is deemed as acceptance of our terms and conditions and fees, which are non-negotiable.

5.A client confirming the booking of an adhoc or temporary nanny is deemed as acceptance of our terms and conditions and fees, which are non-negotiable.

6.Candidate confidentiality and safety is really important to us. Sharing any personal information you have about your nanny, providing your personal contact details to a nanny directly or asking a nanny for their personal contact details before the start date of the contract is prohibited and legal action would be taken in this situation.

7.If you already work with other agencies, you warrant as a client that you will keep The Nanny Club updated regarding your nanny employment situation and childcare needs.

8.If The Nanny Club provides details of a candidate either verbally or in writing before another agency, then this candidate cannot be accepted as having been introduced by another agency. The client would then be liable for The Nanny Club’s agency fee if they were to employ that candidate in any capacity.

9.Once a successful candidate has been chosen, it is the client’s duty to notify The Nanny Club. The client must confirm in writing within 5 days of any job offer.
10.If a candidate was initially rejected by a client and then subsequently employed him/her at a later date (within 12 months) then the agency fee is still applicable.

11.The client is responsible for the candidate’s salary, income tax, national insurance contributions, pension and other deductions required by law, related calculations and administration relating to these matters will be carried out by The Nanny Club if a client opts for The Nanny Club to manage the employment of the nanny.

12. The Nanny Club acts in good faith by carrying out required checks on eligibility to reside and work in the UK, DBS status, qualifications and references. The Nanny Club cannot be held liable for any errors, omissions or false statements or documents that we could not have been reasonably aware of.

13. Temporary and adhoc nannies must be re-booked through The Nanny Club and not directly through the candidate.
14. Payment of fee is due on acceptance of employment, and not on the commencement of employment or signing of a contract between employee/employer.

15. All agency fees are to be settled within 7 days of invoice date, failure to do so will mean a 10% increase or the agency reserves the right to withdraw the candidate and/or commence recovery action. The fee must be settled before the candidate starts the position.

16. If, after payment of the fee in full, the candidate withdraws from any arrangements made prior to the date of employment, The Nanny Club will provide a free replacement where possible.
17. If the client withdraws after firm booking has been made (i.e. candidate accepts the post verbally or in writing) 70% of the placement fee will be payable.

18. If a candidate leaves due to unsatisfactory working conditions, safeguarding concerns, the Client’s breach of contract or law, or a clash of personalities, a refund will not be payable.
19. Refunds are subject to the following circumstances:
-The employee leaves a position due to his/her own circumstances within 4 weeks of employment, and a replacement nanny cannot be found.
-The client terminates the contract within 4 weeks of employment (for a justified reason) and a replacement nanny cannot be found.
-Provided client has paid the full invoice within the payment due date.
-The client has informed the agency within 48 hours of employee leaving.

Up to 2 weeks of employment – 75% refund Up to 3 weeks of employment – 60% refund Up to 4 weeks of employment – 45% refund

20. Candidates who are registered members of The Nanny Club are not to be introduced to third parties without representation from The Nanny Club, this would result in the client being responsible for the relevant agency fee.
21. If a temporary candidate is offered a permanent contract with the client, the appropriate fee will be charged. This is in addition to sums already paid.
22. If the client increases the hours further than what was initially stated within the first 6 months of employment, the appropriate agency fee will then be due.
23. It is the client’s responsibility to inform The Nanny Club of any complicated family situations that a childcarer may need to be aware of, adoptive children, or if social services are involved. Failure to do so will mean The Nanny Club cannot be held liable for any related disputes.

24. It is a legal requirement to inform your nanny that you are using a surveillance camera in/outside the family home.
25. Force Majeure. The Nanny Club is not liable for failure or delay of the start date, due to but not limited to acts of God, war, strikes, accidents, fire and pandemics etc.
26. The client is responsible for their choice of candidate and is expected to take reasonable steps in choosing the most appropriate candidate for their household. Therefore, the agency cannot be held liable for any loss, damage, injury or death the client may suffer by employing a candidate introduced by The Nanny Club.

These Terms and Conditions are governed by the jurisdiction of the Courts of England and Wales.
